The Sixth Chamber of the Administrative Litigation Court awarded this Friday, May 19, a provisional protection to the match Changewith which the candidacies of the candidates for different public positions postulated by the party would be suspended Citizen Prosperityincluding that of the presidential candidate Carlos Pineda.
On May 15, the aforementioned instance processed the amparo and ordered the General Directorate of the Citizens’ Registry of the Supreme Electoral Tribunal (TSE) to deliver a detailed report on the case, for which it was granted a period of 48 hours.
The amparo action argues that the ordinary national assembly of Citizen Prosperity that proclaimed Pineda as a candidate for the Presidency was not held illegally. In this sense, it requests that the participation of the party and of the registered candidates for the June 2023 elections be suspended.
However, said political grouping can appeal to the Constitutional Court (CC).
#EUElections2023 Through tears, the presidential candidate for Citizen Prosperity called for national unity. “Let’s fight together in a Guatemala that can’t take it anymore,” he said.

Pineda’s legal team takes action to stop amparo
Today it was confirmed that Carlos Pineda’s legal team filed an action in the Sixth Chamber of the Administrative Litigation Court to stop the amparo filed against an assembly of the organization.
“It was requested that the process be suspended and the amparo presented by the political party Cambio be filed because they did not exhaust the resources that article 19 of the Amparo law requires,” said lawyer Erick Castillo.
The legal professional added that said political grouping did not exhaust the corresponding actions in law, so there are “deficiencies”. In this sense, he assured that the proposed action does not have the possibility of examining the merits of the matter, he also said that the actions are “spurious.”
In addition to this situation, Prosperidad Ciudadana faces a sanction issued by the TSE, which consists of the payment of 5 thousand dollars. This occurred because Pineda entered a meeting between electoral authorities and magistrates without being authorized to do so.
