It’s official: Jack Dorsey is questioned under oath in the legal battle between Twitter and Elon Musk over the purchase agreement

Jack Dorsey, co-founder of Twitter, is being questioned under oath this morning as part of the clarification process in Elon Musk’s legal battle with Twitter, according to Bloomberg.

The statement takes place via Zoom. Musk’s legal team already subpoenaed Dorsey in August.

Twitter’s lawsuit against Musk seeks to force him to buy the company for $44 billion, after trying to abandon his purchase in July. Since then, Musk has repeatedly countersued the company.

Twitter has declined to comment on the matter, while Dorsey has also not responded to Twitter’s request for comment. Business Insider before publication.

Musk’s original legal request asks for any documents or communications that Dorsey may possess from January 1, 2019 in connection with the merger“the impact or effect of fake or spam accounts on Twitter’s business and operations.”

In addition, it also requires any system Twitter may have used in relation to detecting and tagging spam accounts.

The billionaire’s legal team accuses Twitter of having a “scheme” to mislead investors about the company’s prospects and intentionally “miscounting” the number of spam accounts on the platform.

In the meantime, Twitter says Musk’s complaints are simply an excuse for them to back out of the deal.

Dorsey, for his part, stepped down as CEO of the social media company in November, leaving the company to current CEO Parag Agrawal.

Dorsey is a longtime friend of Musk’s. He supported the billionaire when he tried to take a seat on the Twitter board in Aprilbefore deciding to buy the company outright.

In April, Dorsey called Musk the “single solution I trust” as the company’s leader.

Dorsey has also been fairly receptive to Musk’s comments about the company in the past, criticizing the company’s leadership since leaving Twitter to focus on managing Block.

Over the past month, both sides in the court battle have filed more than 100 subpoenas. In August, Musk’s legal team filed several legal filingsincluding subpoenas to 2 former Twitter employees and several companies, including Discord.

Twitter also issued a series of legal requests to some of Musk’s closest associates, including PayPal co-founder David Sacks and billionaire Larry Ellison.

At the time, Sacks said he planned to fight the subpoena, calling the legal requests “a gigantic harassing expedition.”

Last week, Twitter called Musk’s third attempt to abandon the Twitter deal “invalid and misguided.” The latest argument from the billionaire’s legal team focuses on a report by a former Twitter security chief.

The 5-day court battle is scheduled for early October. Several experts have already explained to Business Insider that Musk faces an uphill battle in his efforts to get out of the deal, due to the unbreakable contract he signed earlier this year.
